Historically, hypotheses failed in most cases to correctly forecast the workings of complex biological systems. Francis Crick’s adaptor hypothesis, however, stands out as an exceptional case of a confirmed abstract prediction. This hypothesis presciently anticipated the existence of RNA adaptors that function as bridges between amino acids and the chemically different nucleic acid template for proteins. Crick conjectured that the adaptors are enzymatically charged with cognate amino acids, they bind to complementary protein-coding nucleic acid, and their liberated amino acids are (...) incorporated into growing protein chains. Independently from and concomitantly with Crick’s hypothesis, Mahlon Hoagland and Paul Zamecnik conducted experiments with no guiding theory that culminated in discoveries of the actual adaptors, transfer RNA (tRNA) molecules, and their amino acids charging enzymes. This paper traces the parallel histories of Crick’s adaptor hypothesis and of the experimental discovery of tRNA and compares their relative impacts on the scientific community. Remarkably, despite the brilliance of Crick’s confirmed prognostication, it had marginal impact on practicing scientists. Conversely, Hoagland and Zamecnik’s experimental discoveries and their evidence-based model of protein synthesis had immediate and enduring impact. I discuss possible explanations for the different impacts of the theoretical prediction and experimental identifications of the same entities. (shrink)

Objective: Compassion has been associated with eudaimonia and prosocial behavior, and has been regarded as a virtue, both historically and cross-culturally. However, the psychological study of compassion has been limited to laboratory settings and/or standard survey assessments. Here, we use an experience sampling method (ESM) to compare naturalistic assessments of compassion with standard assessments, and to examine compassion, its variability, and associations with eudaimonia and prosocial behavior. -/- Methods: Participants took a survey which included standard assessments of compassion and eudaimonia. (...) Then, over four days, they were repeatedly asked about their level of compassion, eudaimonia, and situational factors within the moments of daily life. Finally, prosocial behavior was tested using the Dual Gamble Task and an opportunity to donate task winnings. -/- Results: Analyses revealed within-person associations between ESM compassion and eudaimonia. ESM compassion also predicted eudaimonia at the next ESM time point. While not impervious to situational factors, considerable consistency was observed in ESM compassion in comparison with eudaimonia. Further, ESM compassion along with eudaimonia predicted donating behavior. Standard assessments did not. -/- Conclusion: Consistent with virtue theory, some individual’s reports displayed a probabilistic tendency toward compassion, and ESM compassion predicted ESM eudaimonia and prosocial behavior toward those in need. Observational and experimental discoveries of new factual entities such as objects, systems, or processes, are major contributors to some advances in the life sciences. Yet, whereas discovery of theories was extensively deliberated by philosophers of science, very little philosophical attention was paid to the discovery of factual entities. This paper examines historical and philosophical aspects of the experimental discovery by Carl Woese of archaea, prokaryotes that comprise one of the three principal domains of the phylogenetic tree. Borrowing Kuhn’s terminology, this (...) discovery of a major biological entity was made during a ‘normal science’ project of building molecular taxonomy for prokaryotes. Unexpectedly, however, an observed anomaly instigated the discovery of archaea. Substantiation of the existence of the new archaeal entity and consequent reconstruction of the phylogenetic tree prompted replacement of a long-held model of a prokarya and eukarya bipartite tree of life by a new model of a tripartite tree comprising of bacteria, archaea, and eukarya. This paper explores the history and philosophical implications of the progression of Woese’s project from normal science to anomaly-instigated model-changing discovery. It is also shown that the consequential discoveries of RNA splicing and of ribozymes were similarly prompted by unexpected irregularities during normal science activities. It is thus submitted that some discoveries of factual biological entities are triggered by unforeseen observational or experimental anomalies. (shrink)

Vocal fry is a phonation, or voicing, in which an individual drops their voice below its natural register and consequently emits a low, growly, creaky tone of voice. Media outlets have widely acknowledged it as a generational vocal style characteristic of millennial women. Critics of vocal fry often claim that it is an exclusively female vocal pattern, and some say that the voicing is so distracting that they cannot understand what is being said under the phonation. Claiming that a phonation (...) is so distracting as to prevent uptake of the semantic content of an utterance associated with it is an extreme reaction, especially when accompanied by demands for women to change their phonation. We argue that this reaction limits women's communicative autonomy. We analyze the extreme reaction to female vocal fry, which we characterize as a non-content-based response, from the perspectives of philosophy of language, feminist epistemology, and linguistics. We argue that when fry is heard as annoying and distracting, it is because the hearer interprets the speaker as echoing an utterance from a position of authority to which she is not entitled. We show that this reaction encodes conscious or unconscious sexist attitudes toward women's voices. (shrink)

Objectives: The main goal of this expert system is to get the appropriate diagnosis of disease and the correct treatment. Methods: In this paper, the design of the proposed Expert System was produced to help farmers and those interested in agriculture in diagnosing many of the Bean diseases such as Fusarium wilt, Charcoal rot or ashy stem blight, Bacterial leaf spot and blight, Mung bean yellow mosaic virus, Cercospora leaf spot. The proposed expert system presents an overview of Bean diseases are given, the cause of diseases outlined and the treatment of disease whenever possible is given out. CLIPS Expert System language was used for designing and implementing the proposed expert system. Results: The proposed Bean diseases diagnosis expert system was evaluated by Agricultural experts and some friends interested in agriculture and they were satisfied with its performance. There is a natural story about what logic is that sees it as tied up with two operations: a ‘throw things into a bag’ operation and a ‘closure’ operation. In a pair of recent papers, Jc Beall has fleshed out the account of logic this leaves us with in more detail. Using Beall’s exposition as a guide, this paper points out some problems with taking the second operation to be closure in the usual sense. After pointing out these problems, I (...) then turn to fixing them in a restricted case and modulo a few simplifying assumptions. Abstract: Fast food refers to quick, convenient, and ready-to-eat meals that are usually sold at chain restaurants or take-out establishments. Fast food is often criticized for its unhealthy ingredients, such as high levels of salt, sugar, and unhealthy fats, and its contribution to the growing obesity epidemic. Despite this, fast food remains popular due to its affordability, convenience, and widespread availability. Many fast food chains have attempted to respond to these criticisms by offering healthier options, such as salads and grilled (...) chicken sandwiches, and by using more natural and locally sourced ingredients. The aim in this paper to propose a deep learning model for the classification of fast food dishes. The proposed model, Xception, was trained on natural images and was fine-tuned to make up the fast food meals. The researchers collected the Fast Food V2 dataset from Kaggle depository, the dataset, contained 20,000 images. The dataset has ten labels of food images comprised of Baked Potato, Burger, Crispy Chicken, Donut, Fries, Hot Dog, Pizza, Sandwich, Taco, and Taquito. The dataset was split into three sets: training, validation and testing. The accuracy, F1-score, recall, precision on the separate test set showed that classification of fast food was accuracy (95.13%), Precision (95.34%), Recall (95.13%), and F1-Score (95.14%). (shrink)

This essay provides an interpretation of the potential and limits of Michael Fried's difficult claims in his essay "Art and Objecthood" (1967) that cinema by its nature escapes the problems of modernism and also escapes the problems of theater. By focusing on Stanley Cavell's account of how cinema as an automatic medium escapes problems associated with variability across performances, I try to render a version of Fried's claim about cinema and theater that can ground a figurative version of (...) his claim about cinema and modernism, where film at least provides us a symbol of relief from concerns about medium specificity. In the second part of the essay I argue that something close to Cavell's and Fried's thoughts (about using the figure of theater to remind us of cinema's specificity, but also of cinema in its character as a symbol of relief from medium-specific concerns) takes on a certain urgency in questions about what cinema is in the digital age, manifested in representations of theater in the digitally photographed "Shakespeariadas" series by the contemporary Argentine filmmaker Matías Piñeiro. In a recent online lecture, the acclaimed novelist Amit Chaudhuri responded to an accusation that has greeted his fiction since the start of his literary career: that since, as he openly admits, his novels contain people and events that are drawn from his own life, they are better thought of as thinly disguised memoirs—as not really novels at all. In this paper, I discuss this charge by drawing on an account by the philosopher Stephen Mulhall of the work of another (...) distinguished novelist—J.M. Coetzee (more specifically, that work which features the character Elizabeth Costello). In particular, I want to establish the pertinence to Chaudhuri’s lecture of Mulhall’s analogy between aspects of that work and the work of the influential art historian and critic Michael Fried on the history of modernist painting. In so doing, I aim to show that the commitment to the projects of literary modernism and realism which Mulhall sees in Coetzee (and Costello), can also be seen in Chaudhuri’s understanding of the sense in which his novels both are, and are not, autobiographical. In view of the current progress of what has been named the ‘visual turn’ or the ‘pictorial turn’,1 it is exciting to witness Sam Rose’s return to early aesthetic formalist-modernism, which was so passionate about the medium, its appearance, and visuality. Rose’s project shares a recent inclination to think anew the advent of aesthetic modernism.2 It is founded on the presumption that visual art ought to be – and actually has always been – theoretically subsumed under one meta-project. This meta-project (...) does not necessarily have a clear telos, but it does have a history. In support of this view, Rose appeals to Stanley Cavell’s claim that ‘only masters of a game, perfect slaves to that project, are in a position to establish conventions which better serve its essence. This is why deep revolutionary changes can result from attempts to conserve a project, to take it back to its idea, keep it in touch with its history’ (p. 155). Logic diagrams have been increasingly studied and applied for a few decades, not only in logic, but also in many other fields of science. The history of logic diagrams is an important subject, as many current systems and applications of logic diagrams are based on historical predecessors. While traditional histories of logic diagrams cite pioneers such as Leibniz, Euler, Venn, and Peirce, it is not widely known that Kant and the early Kantians in Germany and England played a crucial role (...) in popularising Euler(-type) diagrams. In this paper, the role of the Kantians in the late eighteenth and early nineteenth centuries will be analysed in more detail. It shows that diagrams (or intuition in general) were a highly contentious topic that depend on the philosophical attitude and went beyond logic to touch on issues of physics, metaphysics, linguistics and, above all, mathematics. Hegel experienced several personal, political, and professional crises during his life. These crises impacted his dense theory about the importance of rational self-reflection in the organic character and evolution of law. The article argues that Hegel’s Preface to the Philosophy of Right manifests how one philosopher came to terms with the personal, social and political crises in which he found himself. In particular, the article outlines the central themes of the Preface and then explicates the important notion of Bildung in (...) Hegel’s theory – an Enlightenment notion that Hegel absorbed from his own formal education. After retrieving Hegel’s reading of the virtues and flaws in Kant’s theory of law, the article then explicates Hegel’s understanding of freedom. The article then reviews the local politics in which Hegel found himself before, during and after Napoleon’s defeat. The article then turns to his professional rivalries with Jacob Fries and Friedrich Savigny. The article argues that the personal animosities shaped parts of his Preface. These complex influences and concerns explain why Hegel waited 20 years to publish his theory of law. Hegel’s Preface comes to terms with the crises of his own times. (shrink)

Karl Popper has often been cast as one of the most solitary figures of twentieth-century philosophy. The received image is of a thinker who developed his scientific philosophy virtually alone and in opposition to a crowd of brilliant members of the Vienna Circle. This paper challenges the received view and undertakes to correctly situate on the map of the history of philosophy Popper’s contribution, in particular, his renowned fallibilist theory of knowledge. The motive for doing so is the conviction that (...) the mainstream perspective on Popper’s philosophy makes him more difficult to understand than might otherwise be the case. The thinker who figures most significantly in the account of Popper developed in these pages is Leonard Nelson. Both a neo-Friesian and neo-Kantian, this philosopher deeply influenced Popper through his student Julius Kraft, who met with Popper on numerous occasions in the mid 1920s. It is in the light of this influence that we understand Popper’s recollection that when he criticized the Vienna Circle in the early 1930s, he looked upon himself “as an unorthodox Kantian”. In recent years, the opioid crisis in the United States has sparked significant discussion on doctor–patient interactions concerning chronic pain treatments, but little to no attention has been given to investigating the vocal aspects of patient talk. This exploratory sociolinguistic study intends to fill this knowledge gap by employing prosodic discourse analysis to examine context-specific linguistic features used by the interlocutors of two distinct medical interactions. We found that patients employed both low pitch and creak as linguistic resources when describing (...) chronic pain, narrating symptoms and requesting opioids. The situational use of both features informs us about the linguistic ways in which patients frame fraught issues like chronic pain in light of the current opioid crisis. This study expands the breadth of phonetic analysis within the domain of discourse analysis, serving to illuminate discussions surrounding the illocutionary role of the lower vocal tract in expressing emotions. Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus epistemological circular argument). (...) However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. The problem of synthetic judgements touches on the question of whether philosophy can draw independent statements about reality in the first place. For Kant, the synthetic judgements a priori formulate the conditions of the possibility for objectively valid knowledge. Despite the principle fallibility of its statements, modern science aims for objective knowledge. This gives the topic of synthetic a priori unbroken currency. This paper aims to show that a modernized version of transcendental philosophy, if it is to be feasible at (...) all, must “bid farewell” to the concept of being “free of empiricism” or the “purity” of the a priori. Approaches to this end can already been found in Kant’s reflections on non-pure synthetic knowledge. Moreover, the a priori validity of knowledge does not exclude the possibility that it can be discovered empirically. In keeping with Kant, Fries and Nelson anticipated this separation (usually first attributed to Reichenbach) between the validity and discovery context of knowledge and pointed out that the a priori could be discovered empirically, but never proven. There are currently still good reasons why transcendental philosophical concepts are of fundamental importance for modern science, although it must not be overlooked that even within the framework of a modernized transcendental philosophy, several unsolved problems remain or are raised. For example, the irredeemability of the universal validity and necessary claims of the a priori, the problem of a clear demarcation between the phenomenal and noumenal world. According to Kant, synthetic judgments formulate the conditions for the possibility of objectively valid knowledge a priori. As far as empirical attempts at reinterpretation of the aprioristic fall short of this ambition, Kant’s a priori goes deeper. This is because modern science strives towards objective knowledge, although (...) its statements are fundamentally fallible. The topic of synthetic a priori thus continues to be relevant. -/- This paper will show that, in order to be viable at all, a modernized version of transcendental philosophy must ‘depart from’ the concepts of “independence from empirics” and/or the “purity” of the aprioristic. Kant’s reflections on non-pure synthetic a priori knowledge already contain attempts at this. Furthermore, the aprioristic validity of knowledge does not exclude the possibility, that it can be discovered empirically. Fries and, subsequently, Nelson proceeded with this separation (initially ascribed to Reichenbach) between the contexts of validity and discovery of knowledge, pointing out that the a priori can indeed be discovered empirically, yet never be proven. -/- Currently, there are still a number of valid reasons for arguing that concepts from transcendental philosophy continue to be of fundamental importance for the modern sciences. However, it must not be neglected that, even within a modernized framework of transcendental philosophy various unsolved problems remain and/or are created (such as the unfeasibility of the aprioristic claim to general validity and necessity, the problem of drawing a clear boundary between the noumenal and phenomenal worlds). Hegel’s concern for determinism induced some scholars to interpret his practical philosophy as a form of determinism or as a form of compatibilism. Against both interpretations I will show some historical features of determinism at the edge of XVIII Century aiming to explain Hegel’s concept of determinism. I will pay a special attention to the debate between Ulrich and Kant’s criticism as well as to the peculiar development of kantian presuppositions in Fries’ philosophy. I will illustrate how this debate influenced (...) Hegel’s definition of arbitrariness (Willkür) and how important it could be to understand his distinction between freedom of choice and free will. Barbara Fried described John Rawls’s response to libertarianism as “the unwritten theory of justice.” This paper argues that while there is no need for a new theory of justice to address the libertarian challenge, there is a need for an additional chapter. Taking up Fried’s suggestion that the Rawlsian response would benefit from a revised list of primary goods, I propose to add employment to the list, thus leading to adoption of a full employment principle in the original (...) position that ensures that anyone who wants to work will be able to do so. I argue that although Rawls famously proposed government as employer of last resort, he never integrated that comment into his theory, which lacks a full employment principle and says nothing about the injustice of involuntary unemployment in its ideal theory. I first refute the received view of Rawls’s treatment of employment as required by its importance for citizens’ self-respect, then show that in fact, the full employment assumption is the result of the role of general equilibrium theory in Rawls’s model of a well-ordered society, and indicate why developments in economic theory and economic policy support the proposed revision. The Berlin Group for scientific philosophy was active between 1928 and 1933 and was closely related to the Vienna Circle. In 1930, the leaders of the two Groups, Hans Reichenbach and Rudolf Carnap, launched the journal Erkenntnis. However, between the Berlin Group and the Vienna Circle, there was not only close relatedness but also significant difference. Above all, while the Berlin Group explored philosophical problems of the actual practice of science, the Vienna Circle, closely following Wittgenstein, was more interested in (...) problems of the language of science. The book includes first discussion ever (in three chapters) on Walter Dubislav’s logic and philosophy. Two chapters are devoted to another author scarcely explored in English, Kurt Grelling, and another one to Paul Oppenheim who became an important figure in the philosophy of science in the USA in the 1940s–1960s. The article updates the work of an important Prešov philosopher and educator Andrej Vandrák The Elements of Philosophical Ethics, which shows that scientific personalities of 19th century Prešov were intellectually close to European thought schools. Apart from Kant and Fries Vandrák’s works were also influenced by European philosophy as a whole, thus influencing Vandrák’s perception of inter alia, good and beautiful and the connection between ethical and aesthetic. These thought in Vandrák’s works show known European tendency and the topic which, (...) albeit in a different sense than in his works, became central in the philosophy especially in the second half of the 20th century and is still up-to-date now – aesthetization of ethics. The analyses of aesthetization of ethics in fact prove to be promising in times of rejection of ethical universalism and anthropological essentialism. In this context, some of Vandrák’s works are in this context quite inspirational. Nevertheless, Vandrák shows that also our perception of philosophy is closely related to the European cultural and philosophical traditions and the current philosophical thinking, which should be extremely emphasized in these days. The central aim of astrobiology is to study origins, evolution and distribution of life in the universe, combining data from various disciplines. However, I will argue that from a philosophical standpoint, astrobiology requires the affirmation of astrophilosophy. Fry (2015) claims that philosophical presuppositions guiding science are general, for example, we hold the notion that natural laws necessarily hold at the whole universe at large, and on the basis of the universal applicability of natural laws, the astrobiological research is conducted. Jakosky (...) (2000) mentions that finding any life elsewhere that had an origin independent of that on Earth would be philosophically profound. Kolb (2005) covers various definitions of life and establishes thought experiments about the survival of life in the Solar System. Most of the (scarce) research has dealt with specific philosophical topics in astrobiology, instead of seeing it as a new philosophical discipline or perhaps a new subdiscipline for each of the classical philosophical disciplines. -/- Persson (2013) has made a step towards this by systematizing the most important philosophical questions in astrobiology, along with Dunér (2013) emphasizing its importance for ethics, epistemology, semiotics and linguistics, and cognition. Persson mentions that the justification of resources is a question of ethics, but I would also like to add political philosophy, since not only is there a question of preference over "earthly manners" but also fair distribution of costs and the concept of ownership of the new worlds. The question of a new definition of life is another one, that I would argue holds one of the central places in metaphysics. Persson mentions various definitions of life and that such a discussion is important for both biology and philosophy, a notion I would like to add to by stating that the question of finding another life is also an ontological question, giving us either categorical similarity or dissimilarity, and establishing a new kind, which is of metaphysical importance. Persson also establishes the importance of is it possible to know whether we are alone or not, a question I would like to tie to the modern epistemological questions of possibility of knowledge (cf. Cassam, 2007). Persson also connects astrobiology with ethical questions such as biocentrism or colonization, which also might be tied to philosophy of mind, and philosophy of politics and culture respectively. -/- One major step forward was established recently by Dick (2020), focusing on a new discipline combining astronomy, cosmology, and astrobiology, in which there is a focus on the nature of reasoning, the problematic nature of evidence, the influence of metaphysical preconceptions, the epistemological status of these disciplines, the role of technology, and the mutual interaction between these disciplines. The purpose of this paper is to see how the creation of astrophilosophy could better emphasize the role of philosophy today, and would it behave as a side-by-side major philosophical discipline or a complement to the current philosophical disciplines, for example, bringing new light into metaphysics, epistemology, ethics, or philosophy of mind. In the first case, we would make a metaphysical difference between human-related problems and other possible kinds, and in the second case, we would have to incorporate current astrobiological questions into modern philosophical dialogue, establishing, for example, metaphysics and epistemology of life, or, a possibility to incorporate non-human life into epistemology, philosophy of mind, and philosophy of biology. This goes hand to hand with Dunér's (2013) points of seeing the philosophy of astrobiology as both a type of individual and collective self-understanding, and conceptual analysis. That way, using astrophilosophical novelties, we can improve not only our current philosophical intuitions, but also expand the territory of philosophical subdisciplines to become more universal. -/- . According to commentators like Rosalind Krauss, Briony Fer, Caroline Jones, and Michael Fried, Clement Greenberg’s formalist/positivist device of “medium-specificity” debars errant affective aesthetic experiences that are embodied; despite significant differences in how these theorists arrive at this conclusion, one shared point of emphasis is Greenberg’s inheriting Kant’s disinterested conception of pleasure in reflective judgments of beauty. Offering a textualist review of Kant’s Analytic of the Beautiful, I seek to demonstrate that neither Greenberg, nor Greenberg’s critics, are correct in their (...) account of Kant’s judgments of beauty.1 Specifically, I argue that Greenberg conflates Kant’s conception of judgments of free beauty (pulchritudo vaga) with merely adherent beauty (pulchritudo adhaerens). In formulating a rejoinder to Greenberg and the misplacement of Greenberg as a Kantian, and following Diarmuid Costello, I hope to save a path for a Kantian aesthetics of the present, much in the spirit of other broadly Kantian art historians and philosophers of art/aesthetics (e.g., Thierry de Duve, Paul Guyer, Ido Geiger, etc.). We arrived at the neighborhood in Antwerp where our accommodation, Adagio Aprthotel, was located. The presence of immigrants was the one of the first things that caught my attention. They are everywhere. Enroute to the shops past the train station after dropping off our bags, Amiel and I passed a synagogue, and at McDonald’s (yup, my first meal in Belgium was french fries!), seated at the next table were two Filipinos. Overhearing their chatter, I surmised that they have been living (...) in Antwerp for some time. While intently exploring the surrounding streets, it became obvious that there is a profusion of migrant communities in Antwerp offering a multifaceted panorama of cultural diversity. This iss underscored by the conspicuous presence of Orthodox Jews, Arabs, Africans, and Chinese, the latter ensconced in their own Chinatown. Our neighborhood afforded immersion within a milieu teeming with migrant-owned enterprises, from butcher shops and corner stores to quaint cafés and eateries, predominantly overseen by Middle Easterners and Jews. Our first communal meal was, in fact, at an Arabic restaurant just across our accommodations. (shrink)

This article has to do with the idea that reincarnation can be compatible with physicalism because the basic awareness of a person will exist in and as another person in a future life. It contends that the underlying process of awareness can cease in one life then begin in another, even if the two processes are not the same. I refer to this process as "recurrence." BACKGROUND Patients with chronic pain face significant barriers in finding clinicians to manage long-term opioid therapy (LTOT). For patients on LTOT, it is increasingly common to have them sign opioid treatment agreements (OTAs). OTAs enumerate the risks of opioids, as informed consent documents would, but also the requirements that patients must meet to receive LTOT. While there has been an ongoing scholarly discussion about the practical and ethical implications of OTA use in the abstract, little is known about how clinicians (...) use them and if OTAs themselves modify clinician prescribing practices. OBJECTIVE To determine how clinicians use OTAs and the potential impacts of OTAs on opioid prescribing. DESIGN We conducted qualitative analysis of four focus groups of clinicians from a large Midwestern academic medical center. Groups were organized according to self-identified prescribing patterns: two groups for clinicians who identified as prescribers of LTOT, and two who did not. PARTICIPANTS 17 clinicians from General Internal Medicine, Family Medicine, and Palliative Care were recruited using purposive, convenience sampling. APPROACH Discussions were recorded, transcribed, and analyzed for themes using reflexive thematic analysis by a multidisciplinary team. KEY RESULTS Our analysis identified three main themes: (1) OTAs did not influence clinicians’ decisions whether to use LTOT generally but did shape clinical decision-making for individual patients; (2) clinicians feel OTAs intensify the power they have over patients, though this was not uniformly judged as harmful; (3) there is a potential misalignment between the intended purposes of OTAs and their implementation. CONCLUSION This study reveals a complicated relationship between OTAs and access to pain management. While OTAs seem not to impact the clinicians’ decisions about whether to use LTOT generally, they do sometimes influence prescribing decisions for individual patients. Clinicians shared complex views about OTAs’ purposes, which shows the need for more clarity about how OTAs could be used to promote shared decision-making, joint accountability, informed consent, and patient education. In the debates regarding the ethics of human organoid biobanking, the locus of donor autonomy has been identified in processes of consent. The problem is that, by focusing on consent, biobanking processes preclude adequate engagement with donor autonomy because they are unable to adequately recognise or respond to factors that determine authentic choice. This is particularly problematic in biobanking contexts associated with organoid research or the clinical application of organoids because, given the probability of unforeseen and varying purposes for which (...) a donor’s organoids could be employed and given the different ways in which a donor can relate to her biospecimens, a donor can value her organoids differently in different contexts and her reasons for autonomously permitting use of her cells and tissues in one case may not support an autonomous decision in another. In response, this paper has three aims: firstly, to make the case for why organoid biobanks ought to respect donor autonomy conceived as authentic choice; secondly, to explore the autonomy-respecting limits of established and widely prevalent models of biobank consent; and thirdly, to propose certain conditions that organoid biobanks ought to support or facilitate in order to respect donor autonomy. As these opening quotes acknowledge, the Prisoner’s Dilemma (PD) represents a core puzzle within the formal mathematics of game theory.3 Its rise in conspicuity is evident figure 2.1 above demonstrating a relatively steady rise in incidences of the phrase’s usage between 1960 to 1995, with a stable presence persisting into the twenty first century. This famous two-person “game,” with a stock narrative cast in terms of two prisoners who each independently must choose whether to remain silent or speak, each advancing (...) self-interest at the expense of the other and thereby achieving a mutually suboptimal outcome, mires any social interaction it is applied to into perplexity. The logic of this game proves the inverse of Adam Smith’s invisible hand: individuals acting on self interest will achieve a mutually suboptimal outcome. However, as this chapter illuminates, the assumptions underlying game theory drive this conclusion. (shrink)

With the publication of A Theory of Justice in 1971, John Rawls not only rejuvenated contemporary political philosophy but also defended a Kantian form of Enlightenment liberalism called “justice as fairness.” Enlightenment liberalism stresses the development and exercise of our capacity for autonomy, while Reformation liberalism emphasizes diversity and the toleration that encourages it. These two strands of liberalism are often mutually supporting, but they conflict in a surprising number of cases, whether over the accommodation of group difference, the design (...) of civic education, or the promotion of liberal values internationally. During the 1980’s, however, Rawls began to jettison key Kantian characteristics of his theory, a process culminating in the 1993 release of Political Liberalism and completing the transformation of justice as fairness into a Reformation liberalism. -/- Reconstructing Rawls argues that this transformation was a tragic mistake because it jeopardized the most important features of his theory, viz. the lexical priorities of right, liberty, and fair equality of opportunity as well as the difference principle. Controversially, this book contends that Rawls’s so-called “political turn,” motivated by a newfound interest in diversity and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has pushed liberalism more broadly towards cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. The book then demonstrates that the central elements of justice as fairness can only be defended within the context of a Kantian Enlightenment liberalism and that Rawls’s hope for a more pluralistic grounding for his theory, endorsed by a wide variety of belief systems present in modern democratic societies, is illusory. -/- Reconstructing Rawls is the first book to systematically compare Rawls’s and Kant’s theories and the first to offer an internal critique and reconstruction of justice as fairness, reconceiving it as a comprehensive, universalistic Kantian liberalism. By doing so, it gives us both the vision of a liberal world order—“a republicanism of all states, together and separately,” as Kant put it—and a mode of justification addressed to all men and women, not as members of particular nations, races, and faiths, but as human beings, as citizens of the world. My paper addresses a topic--the implications of Rawls's justice as fairness for affirmative action--that has received remarkably little attention from Rawls's major interpreters. The only extended treatments of it that are in print are over a quarter-century old, and they bear scarcely any relationship to Rawls's own nonideal theorizing. Following Christine Korsgaard's lead, I work through the implications of Rawls's nonideal theory and show what it entails for affirmative action: viz. that under nonideal conditions, aggressive forms of formal equality of (...) opportunity (e.g., sensitivity training, outreach efforts, external monitoring and enforcement) and compensating support (e.g., special fellowship programs, childcare facilities, mentoring, co-op opportunities, etc.) can be justified, but that "hard" and even "soft" quotas are difficult to defend under any conditions. I conclude the paper by exploring the implications of these surprising results for contemporary liberalism more broadly and for constitutional law and public policy. (shrink)

There are three questions associated with Simpson’s paradox (SP): (i) Why is SP paradoxical? (ii) What conditions generate SP? and (iii) How to proceed when confronted with SP? An adequate analysis of the paradox starts by distinguishing these three questions. Then, by developing a formal account of SP, and substantiating it with a counterexample to causal accounts, we argue that there are no causal factors at play in answering questions (i) and (ii). Causality enters only in connection with action.

Jeremy Waldron has recently raised the question of whether there is anything approximating the creative self-authorship of personal autonomy in the writings of Immanuel Kant. After considering the possibility that Kantian prudential reasoning might serve as a conception of personal autonomy, I argue that the elements of a more suitable conception can be found in Kant’s Tugendlehre, or “Doctrine of Virtue”—specifically, in the imperfect duties of self-perfection and the practical love of others. This discovery is important for at least three (...) reasons: first, it elucidates the relationship among the various conceptions of autonomy employed by personal-autonomy theorists and contemporary Kantians; second, it brings to the surface previously unnoticed or undernoticed features of Kant’s moral theory; and third, it provides an essential line of defense against certain critiques of contemporary Kantian theories, especially that of John Rawls. Is “liberal socialism” an oxymoron? Not quite, but I will demonstrate here that it is a much more unstable and uncommon hybrid than scholars had previously thought and that almost all liberals should reject socialism, even in its most attractive form. More specifically, I will show that three leading varieties of liberalism—neutralist, plural-perfectionist, and deliberative-democratic—are incompatible with even a moderate form of socialism, viz., associational market socialism. The article concerns the interpretation of Aquinas' philosophy in the thougt of the swiss theologian Hans Urs Von Balthasar.

Conventional wisdom holds that the von Neumann entropy corresponds to thermodynamic entropy, but Hemmo and Shenker (2006) have recently argued against this view by attacking von Neumann's (1955) argument. I argue that Hemmo and Shenker's arguments fail due to several misunderstandings: about statistical-mechanical and thermodynamic domains of applicability, about the nature of mixed states, and about the role of approximations in physics. As a result, their arguments fail in all cases: in the single-particle case, the finite particles case, and the (...) infinite particles case. (shrink)
